High Roller Club Terms and Conditions

1. Introduction

1.1 These Terms and Conditions (“Terms”) apply to the purchase, use, and related services of the High Roller Bundle (“Product”) and membership in the High Roller Club (“Membership”) provided by Dope Pickle, LLC (“Company”). By purchasing the Product, you (“Customer”) agree to these Terms.

1.2 Dope Pickle, LLC is based in Gilbert, Arizona, USA. References to “we,” “us,” or “our” denote Dope Pickle, LLC.

2. Product Specifications and Disclaimers

2.1 The High Roller Pickleball Paddle features a 3K gold titanium PET weave, charged carbon technology, and a chrome metallic edge guard. Product specifications may slightly vary due to manufacturing processes and materials. We cannot guarantee that all products will be exactly identical.

2.2 The paddle handle contains an NFC chip primarily used for Membership verification and warranty registration. We reserve the right to modify or update the NFC technology and its functionalities without prior notice.

2.3 While the Product is designed to enhance gameplay, we do not guarantee performance improvement or specific outcomes. Use of the Product is entirely at the Customer’s risk.

2.4 The Product is not currently certified by USA Pickleball or other regulatory bodies. Certification may be sought but is not assured, nor should it be expected as standard. Any future certification will be a bonus and not a guaranteed feature.

3. Membership Discount and Fees

3.1 Purchase of the High Roller Paddle grants complimentary Membership to the High Roller Club, offering access to exclusive deals, discounts, and future events.

3.2 We reserve the right to implement recurring Membership subscription fees in the future. If fees are introduced, current Members will be notified at least 30 days in advance. Members are not obligated to continue Membership and may cancel at any time.

3.3 Membership benefits such as discounts (including the 40% discount) and exclusive access are subject to change. We do not guarantee any specific benefits indefinitely. The High Roller Bundle Membership (product) is excluded from lifetime discount.

4. Warranty, Liability, and Indemnification

4.1 The Product includes a limited warranty covering manufacturing defects only. This warranty does not cover damage caused by misuse, abuse, regular wear, unauthorized modifications, or any other non-manufacturing defects.

4.2 Warranty activation requires registration using the paddle’s embedded NFC chip within 30 days of purchase. Failure to register may void warranty coverage. This warranty is non-transferable and valid only for the original buyer.

4.3 We are not responsible for indirect, incidental, or consequential damages, including loss of profits, business disruption, or personal injuries resulting from Product usage or failure.

4.4 We accept no liability for regulatory actions by entities such as USA Pickleball. If the Product becomes banned or non-compliant, we will not issue refunds or exchanges. Customers accept all risks associated with potential regulatory changes.

4.5 The Customer agrees to indemnify and hold harmless Dope Pickle, LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or legal fees resulting from their use of the Product, violation of these Terms, or infringement of third-party rights.

5. Returns, Refunds, and Cancellation Policy

5.1 We offer a 30-day return policy for unused Products in original condition. Returns must first receive authorization from our customer service. Unauthorized returns will not be accepted.

5.2 Refunds for accepted returns will be processed within 14 days of receiving the returned Product. Refunds exclude shipping fees and will be returned to the original payment method. Return shipping costs are the Customer’s responsibility unless the return is due to a manufacturing defect.

5.3 Returns or refunds will be refused if Products are damaged or altered in any way not covered by warranty terms.

5.4 Memberships and digital services included with Product purchases are non-refundable and non-transferable.

6. Intellectual Property

6.1 All intellectual property related to the Product, including designs, technology, trademarks, and NFC chip content, belongs exclusively to Dope Pickle, LLC.

6.2 Unauthorized use, reproduction, or distribution of our intellectual property is prohibited and may lead to legal action.

7. Data Privacy and Security

7.1 We value Customer privacy and are committed to protecting personal information. Data collected through the NFC chip or registration will be handled according to our Privacy Policy.

7.2 While we implement reasonable security measures, absolute security cannot be guaranteed. Customers acknowledge the inherent risks involved with online communication and data storage.

8. Changes to Terms and Conditions

8.1 We reserve the right to amend these Terms at any time. Significant changes will be communicated via email or announced on our website.

8.2 Continued usage of the Product or Membership following changes indicates acceptance of the revised Terms. Customers disagreeing with revised Terms must cease use immediately.

9. Governing Law and Jurisdiction

9.1 These Terms and any related disputes will be governed by the laws of the State of Arizona, excluding conflict of law principles.

9.2 Disputes will be resolved exclusively through binding arbitration in Gilbert, Arizona, under American Arbitration Association (AAA) rules. Customers waive rights to jury trials and participation in class-action lawsuits.

10. Miscellaneous

10.1 These Terms represent the complete agreement between the Customer and us concerning the Product and supersede any previous agreements or understandings, whether written or verbal.

10.2 If any provision of these Terms is deemed invalid or unenforceable, remaining provisions will remain fully effective.

10.3 Our failure to enforce any right or provision within these Terms does not imply a waiver.

10.4 These Terms do not establish any form of agency, partnership, joint venture, or employment relationship between the Customer and us.
