High Roller Paddle Terms and Conditions

1. Introduction

1.1 These Terms and Conditions ("Terms") govern the sale, use, and associated services of the High Roller Bundle ("Product") and the High Roller Club membership ("Membership") offered by Dope Pickle, LLC ("Company"). By purchasing the Product, the Customer agrees to be bound by these Terms.

1.2 The Company is headquartered in Gilbert, Arizona, USA. Any reference to "we," "us," or "our" refers to Dope Pickle, LLC.

2. Product Specifications and Disclaimers

2.1 The High Roller Pickleball Paddle is designed with an 18K gold titanium alloy weave, charged carbon technology, and a chrome metallic edge guard. While the Company strives to provide accurate product descriptions, actual product features and specifications may vary due to manufacturing processes and materials. The Company does not guarantee that all Products will be identical.

2.2 The inclusion of the NFC chip in the paddle handle is for Membership verification and warranty registration purposes. The Company reserves the right to update or modify the NFC technology or its associated features without prior notice.

2.3 The Product's design and construction aim to enhance the playing experience; however, the Company does not warrant or represent that the Product will improve the Customer's performance or guarantee any specific outcomes. The use of the Product is at the Customer's own risk.

2.4 The Product is not currently certified by USA Pickleball or any other governing body. The Customer acknowledges that while the Company may seek certification, approval is not guaranteed and should not be assumed as a standard feature. Any certification obtained will be considered an additional benefit and does not constitute a promise or warranty by the Company.

3. Membership and Subscription Fees

3.1 The purchase of the High Roller Paddle includes Membership to the High Roller Club for free, providing access to exclusive offers, discounts, and events.

3.2 The Company reserves the right to introduce a recurring subscription fee for continued Membership at any time. Should such a fee be implemented, the Company will provide existing Members with at least 30 days' notice. The introduction of a subscription fee will not obligate Members to continue their Membership, and they may opt out at any time.

3.3 Membership benefits, including discounts and access to exclusive events, are subject to change at the Company's discretion. The Company is not responsible for maintaining any specific benefit or service indefinitely.

4. Warranty, Liability, and Indemnification

4.1 The Company provides a limited warranty against manufacturing defects for the Product. This warranty does not cover damage resulting from misuse, abuse, normal wear and tear, unauthorized modifications, or any other damage not caused by a defect in material or workmanship.

4.2 To activate the warranty, the Customer must register the Product using the embedded NFC chip within 30 days of purchase. Failure to register may result in the forfeiture of warranty coverage. The warranty is non-transferable and applies only to the original purchaser.

4.3 The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Product. This includes, but is not limited to, damages for loss of profits, business interruption, or personal injury.

4.4 The Company is not liable for the actions or decisions of regulatory bodies, including but not limited to USA Pickleball. Should the Product be banned or deemed non-compliant, the Company will not be responsible for any resulting losses, including the purchase price, and will not offer refunds or exchanges. The Customer assumes all risks associated with the potential regulatory changes.

4.5 The Customer agrees to indemnify and hold harmless Dope Pickle, LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from the Customer's use of the Product, violation of these Terms, or infringement of any third-party rights.

5. Returns, Refunds, and Cancellation Policy

5.1 The Company offers a 30-day return policy for Products in new and unused condition. To initiate a return, the Customer must contact the Company's customer service for a return authorization. Returns without authorization will not be accepted.

5.2 Refunds will be processed within 14 days of receiving the returned Product, provided it meets the return criteria. The refund will be issued to the original payment method, minus any shipping costs. The Customer is responsible for return shipping unless the return is due to a manufacturing defect.

5.3 The Company reserves the right to refuse a return or refund if the Product is found to be damaged or altered in any way not covered by the warranty.

5.4 Memberships and digital services included with the Product purchase are non-refundable and non-transferable.

6. Intellectual Property

6.1 All intellectual property rights related to the Product, including but not limited to design, technology, trademarks, and content provided through the NFC chip, are the exclusive property of Dope Pickle, LLC.

6.2 Unauthorized use, reproduction, or distribution of the Company's intellectual property is strictly prohibited and may result in legal action.

7. Data Privacy and Security

7.1 The Company respects the Customer's privacy and is committed to protecting personal information. Any data collected through the NFC chip or during the registration process will be used in accordance with the Company's Privacy Policy.

7.2 The Company employs reasonable security measures to protect against unauthorized access to Customer data. However, the Company cannot guarantee absolute security, and the Customer acknowledges and accepts the inherent risks of online communication and data storage.

8. Changes to Terms and Conditions

8.1 The Company reserves the right to modify these Terms at any time. Any significant changes will be communicated to the Customer via the email address provided during registration or through an announcement on the Company’s website.

8.2 Continued use of the Membership or Product after any changes have been made constitutes acceptance of the new Terms. If the Customer does not agree to the revised Terms, they must discontinue use of the Product and Membership services.

9. Governing Law and Jurisdiction

9.1 These Terms and any disputes arising out of or related to them or the Product shall be governed by the laws of the State of Arizona, without regard to its conflict of law principles.

9.2 Any disputes arising from or related to these Terms, the Product, or the Membership shall be resolved exclusively through binding arbitration in Gilbert, Arizona, in accordance with the rules of the American Arbitration Association (AAA). The Customer agrees to waive any right to a jury trial or to participate in a class action lawsuit.

10. Miscellaneous

10.1 These Terms constitute the entire agreement between the Customer and the Company regarding the purchase and use of the Product and supersede all prior agreements or understandings, whether written or oral.

10.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.3 The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

10.4 These Terms do not create any agency, partnership, joint venture, or employment relationship between the Customer and the Company.
